"Company" refers to Integral Foundation for Human Development CARSA and its affiliates.
"Service" means the website, platform, tools, features, and services provided by the Company.
"User" refers to any individual or entity accessing or using the Service, including Campaign Owners and Contributors.
"Campaign" means any fundraising initiative created and managed by a Campaign Owner through the Service.
"Campaign Owner" refers to a User who creates and manages a Campaign through the Service.
"Contributor" means a User who makes a Contribution to a Campaign.
"Contribution" refers to any donation or payment made by a Contributor to a Campaign.
"Incentive" means any product, service, reward, or benefit offered by a Campaign Owner to Contributors.
"Login Service" refers to any third-party authentication service used to access the Service.
"Payment Provider" means any company or service that processes Contributions made to Campaigns.
You must be at least eighteen (18) years of age to use the Service. Individuals between the ages of thirteen (13) and seventeen (17) may use the Service only with the prior consent and ongoing supervision of a parent or legal guardian who is at least eighteen (18) years old. By granting such consent, the parent or legal guardian accepts these Terms on behalf of the minor and agrees to be fully responsible and liable for the minor's access to and use of the Service.
You are not eligible to access or use the Service if you have previously been suspended, terminated, or removed, unless we have expressly authorized you in writing to resume use.
We reserve the right, in our sole and absolute discretion, to deny, restrict, suspend, or terminate access to the Service, and to reject, cancel, interrupt, remove, or suspend any Campaign or account, at any time, with or without notice, and without liability to you or any third party.
All Campaign contributions are processed via the payment provider(s) selected by the relevant Campaign Owner.
Users acknowledge that any transactions carried out through the Service are governed by the applicable payment provider's terms of service and related agreements. The Company operates independently from all payment providers and does not act as their agent, partner, or employee. Likewise, payment providers do not act on behalf of the Company. Each party is solely responsible for its own actions, performance, or failure to perform. The same independent relationship applies between the Company and Users.
Where the Service is used alongside third-party services, Users understand that they may also be bound by those third parties' terms and conditions. In such circumstances, neither the Company nor any third-party provider shall be deemed to have an agency, employment, or partnership relationship with one another, nor shall either be liable for the acts or omissions of the other.
Nothing in these Terms overrides or replaces the terms of any third-party service provider, nor do third-party terms override these Terms in relation to use of the Service.
By accessing or using the Service, Users expressly consent to the deduction of applicable service fees by the relevant payment provider.
Unless expressly stated otherwise, any new features, updates, or enhancements that modify or expand the Service shall be governed by these Terms. You acknowledge and agree that the Service is provided on an "AS IS" basis, and that the Company assumes no responsibility or liability for the timeliness, deletion, misdelivery, or failure to store any communications, data, or personalization settings.
As a Contributor, it is your responsibility to ask questions and review Campaigns to the extent you deem necessary before making any Contribution. All Contributions are made voluntarily, at your own discretion, and entirely at your own risk. The Company does not guarantee that Contributions will be used as intended, that Campaign Owners will provide Incentives, or that any Campaign will achieve its objectives.
The Company does not endorse, guarantee, or make any representations regarding the quality, safety, legality, morality, or accuracy of any Campaign, Incentive, or Contribution, nor the truthfulness or reliability of content posted through the Service. You are solely responsible for determining the treatment of your Contribution and any Incentives for tax or reporting purposes.
Rewards, also referred to as Perks, Products, or Tickets, are offered by Campaign Owners to encourage Users to participate in their Campaigns. Campaign Owners agree to the following regarding these Rewards:

If you supply information that is false, inaccurate, outdated, or incomplete, or if the Company reasonably believes that your information falls into any of these categories, the Company may suspend or terminate your access to the Service and deny any present or future use of the Service, in whole or in part.
You are responsible for safeguarding your account credentials and for all activity that occurs through your account in connection with the Service. You agree to notify the Company immediately if you become aware of any unauthorized access or other security breaches related to your account. The Company is not liable for any loss or damage resulting from your failure to protect your account information.
Additionally, you are responsible for ensuring that all content in your Campaign complies with the Service's Terms of Service and Privacy Policy.
By using the Service, you agree to follow all applicable local laws and regulations governing online activity and the content you share. This includes compliance with rules related to electronic commerce, fundraising, and the transfer of technical data from Canada or from your country of residence.
You agree to take responsibility for and protect the Company, its affiliates, subsidiaries, officers, directors, agents, co-branders, other partners, including the Integral Foundation for Human Development CARSA, and employees from any third-party claims or demands. This includes covering reasonable legal fees for issues arising from the information you share or post through the Service, your use of the Service, your connection to it, any breach of these Terms, or any violation of another person's rights.
You may not reproduce, duplicate, copy, sell, resell, or otherwise use any part of the Service for commercial purposes, except as expressly permitted within the Service or with prior written permission from the Company.
The Company may, at its discretion, modify, suspend, or discontinue the Service or any part of it, temporarily or permanently, with or without notice. You acknowledge and agree that the Company is not responsible for issuing any refunds, in whole or in part, for fees paid for the Service. The Company will not be liable to you or any third party for any changes, suspension, or discontinuation of the Service.
The Company may, at its discretion, suspend or terminate your access to the Service at any time, for any reason, including inactivity, nonpayment, or violation of these Terms. Upon termination, the Company may delete your information and block further access without notice. You agree that the Company is not liable to you or any third party for the termination of access or removal of content.
These Terms of Use are governed by the laws of Mexico. Any disputes arising from or relating to these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Mexico, and you consent to the personal jurisdiction of such courts.
