Welcome to Humanocarsa.com (the "Website" or "Platform"), owned and operated by Fundación Integral para el Desarrollo Humano CARSA ("CARSA", "we," "us," or "our") a legally registered non-profit organization (NPO) in Mexico. All donations are collected, processed, and managed exclusively by CARSA in accordance with applicable Mexican law.
These Terms of Use govern your access to our Website, including all content, services, and features provided. By using the Website, you agree to these Terms. If you do not agree, please discontinue use of the site immediately.
We reserve the right to modify these Terms of Use at any time. Any changes will be effective immediately upon posting to the Website. Your continued use of the site following these updates constitutes your acceptance of the revised Terms.
Donations made through CARSA do not constitute investments and do not entitle donors to financial returns, ownership rights, or profit participation.
All content on the Platform, including text, graphics, logos, images, audio, video, and software (collectively, "Content"), is the exclusive property of Fundación Integral para el Desarrollo Humano CARSA ("CARSA") or its licensors and is protected by copyright, trademark, and other intellectual property laws.
CARSA grants Users a limited, non-exclusive, non-transferable license to access and use the Platform and its Content solely for personal, non-commercial purposes related to Campaigns. Users may not copy, modify, distribute, display, or use the Content for commercial purposes, nor remove or alter any proprietary notices, without CARSA's prior written consent.
All rights not expressly granted are reserved by CARSA.
The service we provide is a Platform for individuals, entities, and nonprofit organizations ("NPOs") to create Fundraisers for the purpose of soliciting monetary donations from Donors. Fundraisers may benefit the Fundraiser creator, a third-party Beneficiary, or an NPO.
You must be at least eighteen (18) years of age to use the Service. Individuals between the ages of thirteen (13) and seventeen (17) may use the Service only with the prior consent and ongoing supervision of a parent or legal guardian who is at least eighteen (18) years old. By granting such consent, the parent or legal guardian accepts these Terms on behalf of the minor and agrees to be fully responsible and liable for the minor's access to and use of the Service.
Important Note for Minors: While minors aged 13–17 may browse and view Campaigns with parental consent, making Contributions or creating Campaigns that involve financial transactions requires the minor to be at least 18 years of age or the age of majority in their jurisdiction, or to have their parent or legal guardian complete the transaction on their behalf. This is due to payment provider requirements and legal restrictions on contracts with minors. The parent or legal guardian completing such transactions assumes full responsibility for the financial transaction and any resulting obligations.
You are not eligible to access or use the Service if you have previously been suspended, terminated, or removed, unless we have expressly authorized you in writing to resume use.
We reserve the right, in our sole and absolute discretion, to deny, restrict, suspend, or terminate access to the Service, and to reject, cancel, interrupt, remove, or suspend any Campaign or account, at any time, with or without notice, and without liability to you or any third party.
All Campaign contributions are processed via the payment provider(s) selected by the relevant Campaign Owner. Stripe, Inc. and its affiliates act solely as payment processors and do not own, control, or manage the donations collected. Donations may be processed in multiple currencies. Currency conversion rates, fees, or bank charges may apply depending on the donor's payment provider.
Users acknowledge that any transactions carried out through the Service are governed by the applicable payment provider's terms of service and related agreements. CARSA operates independently from all payment providers and does not act as their agent, partner, or employee. Likewise, payment providers do not act on behalf of CARSA. Each party is solely responsible for its own actions, performance, or failure to perform. The same independent relationship applies between CARSA and the Users.
Where the Service is used alongside third-party services, Users understand that they may also be bound by those third parties' terms and conditions. In such circumstances, neither CARSA nor any third-party provider shall be deemed to have an agency, employment, or partnership relationship with one another, nor shall either be liable for the acts or omissions of the other.
Nothing in these Terms overrides or replaces the terms of any third-party service provider, nor do third-party terms override these Terms in relation to use of the Service.
By accessing or using the Service, Users expressly consent to the deduction of applicable service fees by the relevant payment provider. Information regarding applicable fees is available in the fee schedules published by the relevant payment providers and displayed to Users prior to completing any transaction.
Unless expressly stated otherwise, any new features, updates, or enhancements that modify or expand the Service shall be governed by these Terms. You acknowledge and agree that the Service is provided on an "AS IS" basis, and that CARSA assumes no responsibility or liability for the timeliness, deletion, misdelivery, or failure to store any communications, data, or personalization settings.
As a Contributor, it is your responsibility to ask questions and review Campaigns to the extent you deem necessary before making any Contribution. All Contributions are made voluntarily, at your own discretion, and entirely at your own risk. CARSA does not guarantee that Contributions will be used as intended, that Campaign Owners will provide Incentives, or that any Campaign will achieve its objectives.
CARSA does not endorse, guarantee, or make any representations regarding the quality, safety, legality, morality, or accuracy of any Campaign, Incentive, or Contribution, nor the truthfulness or reliability of content posted through the Service. You are solely responsible for determining the treatment of your Contribution and any Incentives for tax or reporting purposes. CARSA does not provide tax, legal, or financial advice. We strongly recommend that you consult with a qualified tax professional or accountant regarding the tax implications of any Contributions you make or receive through the Service.
CARSA does not guarantee refunds for Contributions and is not responsible for issuing refunds, except where required by law or expressly stated in writing. Any refund requests must be directed to the relevant Campaign Owner or payment provider, subject to their applicable policies.
Rewards, also referred to as Perks, Products, or Tickets, are offered by Campaign Owners to encourage Users to participate in their Campaigns. Campaign Owners agree to the following regarding these Rewards:

If you supply information that is false, inaccurate, outdated, or incomplete, or if CARSA reasonably believes that your information falls into any of these categories, CARSA may suspend or terminate your access to the Service and deny any present or future use of the Service, in whole or in part.
You are responsible for safeguarding your account credentials and for all activity that occurs through your account in connection with the Service. You agree to notify CARSA immediately if you become aware of any unauthorized access or other security breaches related to your account. CARSA is not liable for any loss or damage resulting from your failure to protect your account information.
CARSA processes personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), where applicable. Please refer to our Privacy Policy for further details.
Additionally, you are responsible for ensuring that all content in your Campaign complies with the Service's Terms of Use and Privacy Policy.
By using the Service, you agree to follow all applicable local laws and regulations governing online activity and the content you share. This includes compliance with rules related to electronic commerce, fundraising, and the transfer of technical data from Mexico or from your country of residence.
Users represent and warrant that they are not subject to any economic, trade, or financial sanctions administered or enforced by any national or international authority. Users further agree that Contributions will not be used for any unlawful, prohibited, or sanctioned purposes, including but not limited to money laundering, terrorist financing, or violations of applicable sanctions laws.
You agree to take responsibility for and indemnify CARSA, its affiliates, subsidiaries, officers, directors, agents, co-branders, partners, and employees against any third-party claims, demands, or liabilities. This includes covering reasonable legal fees and expenses arising from any information you post or share through the Service, your use of the Service, your connection to it, any breach of these Terms, or any violation of another person's rights.
You may not reproduce, duplicate, copy, sell, resell, or otherwise use any part of the Service for commercial purposes, except as expressly permitted within the Service or with prior written permission from CARSA.
CARSA may, at its discretion, modify, suspend, or discontinue the Service or any part of it, temporarily or permanently, with or without notice. You acknowledge and agree that CARSA is not responsible for issuing any refunds, in whole or in part, for fees paid for the Service. CARSA will not be liable to you or any third party for any changes, suspension, or discontinuation of the Service.
CARSA may, at its discretion, suspend or terminate your access to the Service at any time, for any reason, including inactivity, nonpayment, or violation of these Terms. Upon termination, CARSA may delete your information and block further access without notice. You agree that CARSA is not liable to you or any third party for the termination of access or removal of content.
These Terms of Use are governed by the laws of Mexico. Any disputes arising from or relating to these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Mexico, and you consent to the personal jurisdiction of such courts.
